Case-by-Case Analysis Decision

 

Under the Legal Framework for Environmental Impact Assessment, Decree-Law No. 11/2023 of 10 February introduced some significant changes to environmental licensing.

 

The decision to subject projects to an EIA, under the terms of Article 3 of Decree-Law No. 151-B/2013, of 31 October, on procedures in this sector, is now, in its current wording, the responsibility of this Directorate-General.

 

The criteria determining whether a project is subject to an EIA have also been revised, with the following now applying:

 

• Under the terms of Article 1(3)(a) and (b)(i) of Decree-Law No. 151-B/2013 of 31 October, when the project falls within the parameters set out in Annexes I and II;

 

• Under the terms of Article 1(3)(b)(ii) and (iii) of the same decree-law, when a project falls within the parameters set out in Annexes I and I, but is considered likely to have a significant impact on the environment due to its location, size or nature, in accordance with the criteria set out in Annex III of the same decree, and in accordance with the provisions of Article 3 (case-by-case analysis).

 

Changes or extensions to existing projects are also subject to analysis, as described above, under the terms of Article 1(4) of the same Decree-Law.

 

Similarly, projects that meet the conditions set out in Article 1(5) of Decree-Law No. 11/2023 of 10 February are now exempt from EIA and case-by-case analysis.

 

Decisions issued in the context of case-by-case analysis are subject to mandatory disclosure under Article 30 of Decree-Law No. 151-B/2013 of 31 October, in its current wording, and are therefore published in the following table:
